In our Agreement we strive to clearly detail the formal arrangement between us and how it will all come together - in other words, the Terms and Conditions governing this Agreement.
>> Clarifying The Terminology
To make the agreement more concise, we refer to the iTrek Affiliate Program as 'The Program'.
As with all documents of this type, iTrek may also be referred to as "us", "we" and "our".
As an individual or company applying for Affiliation, you may also be referred to as "the Affiliate", "you" and "your".
When we state the "referring website" this indicates the website you have chosen to place the banners and editorials, and the associated link.
>> How Does 'The Program' Work?
The Program is actually our software program through which you introduce your visitors to our website. By clicking on any of the links, your site visitors have already indicated their interest in travel insurance, whether it just be obtaining more information, receiving a quote and/or making a purchase though iTrek.
These links will take the visitor through to www.itrektravelinsurance.com.au. They are embedded with a unique code allowing the link, via Internet, between your 'referring' site and our site. Through this link we are also able to track the identity of your site in order to correctly allocate commission payments.
>> Joining the Program
After going through the information on this page, click across to our Application page to complete and submit your application. After we have assessed your application we will notify you if you have been accepted as an Affiliate.
Note: the content on your website will influence our ability to accept your application. Unsuitable content that will exclude a website includes sites that:
- Show or encourage violence or sexually explicit material
- Show, encourage or commit illegal activities
- Encourage discrimination or actively discriminate against individuals or organisations because of sex, religion or race issues
- Violate or promote the violation of rights pertaining to international intellectual property
On the above issues, our decision is final. However, if you have other web sites you wish to apply through or if you change the content of your current web site, you can submit other applications or reapply.
Should offending material be introduced or reintroduced to your referring website, this Agreement will be terminated and we reserve the right to terminate our Agreement with you should your affiliate website be subsequently deemed unsuitable.
>> Choosing and Placing The iTrek Affiliate Referral Material
After acceptance and welcome into The Program, you are able to choose from our graphics, text and code to suit your site. All graphics, text and code, our trademarks and name and other images remain our property. Should you be requested at any time to remove this from your site, it is our right to insist you comply.
Should you decide to delete or include more qualified text, graphics or code it is not necessary to gain approval, however, nothing, including our trademark or other images, can be modified in any way.
>> Identifying The Referral Source To Allocate Commissions
All links are embedded with an iTrek sensitive code allowing us to keep track of and identify the referring website when a customer purchases their insurance policy through us. For this reason it is critical that you correctly use the iTrek links in order to receive your commission. This is the only method available to track customers and for you to receive your commissions.
We are happy to assist you with guidance on placement etc but it is your ultimate responsibility to ensure these links are placed and maintained correctly.
It is our responsibility to process the referred customers' travel insurance and to ensure commission payments are made to Affiliates for all purchasing customers coming via the links on the referral sites. Any orders coming through that do not comply with our present or future requirements may be rejected. We are also responsible for all activities related to payment processing, cancellations, customer service and sales activity reports, which we may or may not divulge.
>> Proper Use Of Links
You, our Affiliate, must have full control over the website that our banners, text, trademark or links are placed on. Any customers who have come direct from the Search Engine natural listings will not earn Affiliate commission payments.
>> Eligibility For Commission Payments
All customers, originating from an eligible iTrek link placed on an Affiliate's approved site and who purchase one of our travel insurance packages, will result in a commission payment for the relevant Affiliate after the customer's payment has been cleared.
The total amount of commission will depend on the type and cost of the travel insurance package purchased. In the event the customer cancels his or her purchase, the commission will be deducted from a future Affiliate payment.
At all times we will endeavour to track customers and sales and efficiently and accurately execute payments to our Affiliates. We can accept no responsibility for errors initiated by you, by ourselves, or through link or tracking software malfunction.
>> Timing For Commission Payments
Each payment will be for the commission earned on the total number of travel insurance products purchased by referred customers coming through your referring website for that particular calendar month, minus any cancellations from the previous calendar month.
All payments will be made directly into the bank account of your choosing approximately twenty days after the end of the relevant calendar month, except when the total commission is less than $50.00. In that event the total commission payment will be carried over to the following month or will be paid in full should the agreement between you and iTrek be terminated.
>> Ownership of Pricing and Product Standards
Though a customer may have arrived at our site via your affiliate link, the customer then becomes our customer when he or she decides to visit our site or purchases one of our products. It is therefore solely our responsibility to handle all pricing, orders, products and customer service. No area relating to products or pricing may be handled by our Affiliates and no pricing can be indicated on our Affiliates websites.
>> The Benefits and Limitations of Our Affiliate Relationship
It is important to understand the full scope of the Affiliate relationship. Though we both stand to benefit through our mutual cooperation, this is only a relationship of voluntary cooperation, which may either be cancelled by iTrek or exited by any of our Affiliates at any time and for any reason without prior notice.
This Agreement is not a legally binding partnership or joint venture, neither party is an agent for the other, our Affiliates are not our sales representatives nor do they operate under a franchise or employment agreement. Neither does either party have the right or authority to accept offers or make decisions or representations for each other.
>> Damages and Liability
iTrek state that we are not liable at any time, whether advised or not, for damages of any kind, be they indirect or consequential, for loss of profits, revenue or data or any other damages arising from entering into this Agreement or through using The Program.
We make no guarantee that our site will operate at all times without interruption or that it will never contain any errors and we do not accept any liability for any flow-on results resulting from an interrupted iTrek service or site error.
We also state we cannot and do not guarantee or offer express or implied representation as to the profitability or effectiveness of undertaking The Program.
>> Nationally Enforced Contract Laws
iTrek and our Affiliates are subject to Australian law as pertaining to these Agreements.
